4M Lift Terms of Service

These Terms of Service, together with any policies referenced in them, govern your access to and use of 4M Lift, including the mobile application, related websites, features, content, subscriptions, and services provided by MatiloLabs LLC.

By downloading, accessing, creating an account for, purchasing, subscribing to, or using 4M Lift, you agree to these Terms. If you do not agree, do not use 4M Lift.

These Terms are not intended to limit any rights you may have under applicable consumer protection laws.

2. Eligibility and Age Requirement

You must be at least 16 years old to use 4M Lift.

If you are at least 16 but under the age of majority where you live, you may use 4M Lift only with the consent and supervision of a parent or legal guardian. By allowing a minor to use 4M Lift, the parent or guardian agrees to these Terms on the minor's behalf and accepts responsibility for the minor's use of the Service.

4M Lift is not intended for children under 16. Do not create an account or use the Service if you are under 16.

3. What 4M Lift Provides

4M Lift is a workout tracking, planning, and fitness organization app. Depending on the features available to you, 4M Lift may allow you to:

• create, save, and track workouts;
• create custom exercises, workout routines, and workout templates;
• review workout history and progress;
• share routines, templates, or workout results;
• access free features; and
• access optional paid features through subscriptions, trials, or lifetime purchases.

Some features may be free. Other features may require a paid subscription, trial, lifetime purchase, or other in-app purchase.

We may add, remove, modify, limit, or discontinue features from time to time.

4. Important Health and Safety Disclaimer

4M Lift provides fitness tracking, planning, and educational tools only. 4M Lift does not provide medical advice, diagnosis, treatment, physical therapy, personal training, nutrition counseling, or professional healthcare services.

You should consult a physician or qualified healthcare professional before beginning a new exercise program, changing your workout routine, or using 4M Lift if you have any medical condition, injury, disability, illness, or concern about your health.

Exercise involves inherent risks, including soreness, sprains, strains, overtraining, injury, illness, and in rare cases serious injury or death. You are solely responsible for deciding whether an exercise, workout, routine, template, goal, or training plan is appropriate for you.

Stop exercising immediately and seek medical attention if you experience pain, dizziness, faintness, shortness of breath, chest pain, unusual discomfort, or any other concerning symptoms.

You use 4M Lift and any workout, routine, template, result, recommendation, or information available through 4M Lift at your own risk.

5. Accounts and Authentication

Some features may require an account. Account authentication is provided using Firebase Authentication or another authentication provider we may use in the future.

When you create an account, you agree to provide accurate and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

At launch, we intend to store only limited account-related information on our systems or with our authentication providers, such as your email address and a unique user identifier. We do not intend to store your name unless you provide it through a feature we add in the future or a third-party sign-in provider supplies it.

You agree not to:

• create an account using false or misleading information;
• access another person's account;
• share your account credentials with others;
• use another person's email, identity, or account information without permission;
• interfere with account security; or
• attempt to bypass authentication, payment, entitlement, or access controls.

We may suspend or terminate your account if we believe you have violated these Terms, created risk for other users, used the Service unlawfully, or abused the Service.

6. Local Storage, Personal Cloud Storage, and Data Responsibility

4M Lift is designed so that your workout logs, routines, templates, custom exercises, workout results, progress data, and similar fitness content are stored on your device and/or in a personal cloud service that you control, depending on your device settings and app configuration.

This means:

• we may not have access to your workout data;
• we may not be able to recover your workout data;
• deleting the app, changing devices, changing cloud settings, disabling sync, deleting local files, clearing app data, or losing access to your personal cloud account may result in permanent data loss;
• your personal cloud provider's terms, privacy policy, storage limits, outages, and sync behavior may affect your data; and
• you are responsible for backing up, exporting, or preserving any workout data you want to keep.

We are not responsible for loss, corruption, deletion, failure to sync, failure to back up, or inability to recover data stored on your device or in your personal cloud account.

If you delete your 4M Lift account, that may delete or disable authentication-related information we control, but it may not delete workout data stored locally on your device, in device backups, or in your personal cloud storage. You are responsible for deleting local or personal-cloud copies if you want them removed.

7. Privacy

Your use of 4M Lift is also governed by our Privacy Policy.

Our Privacy Policy explains what information we collect, how we use it, what third-party services we use, and what choices you may have.

At launch and over time, we may use service providers for authentication, analytics, subscription entitlement management, crash diagnostics, app performance, marketing attribution, and advertising measurement. These may include Firebase Authentication, Google Analytics, RevenueCat, Meta SDK or Meta Business Tools, Apple, Google, and other service providers.

We do not intend to use your workout logs, routines, templates, exercises, workout results, or other detailed fitness content for advertising targeting. If we use analytics or marketing attribution tools, we intend to use general app events such as app install, app open, trial start, subscription start, purchase, renewal, cancellation, or similar conversion and usage events.

Do not include sensitive personal, medical, or health information in any content you choose to share publicly or with others.

8. User Content

"User Content" means content you create, upload, save, enter, export, publish, or share through 4M Lift, including workout routines, templates, custom exercises, workout notes, workout results, progress summaries, images, text, comments, or other materials.

You retain ownership of your User Content.

Because much of 4M Lift is designed around local or personal-cloud storage, we do not need broad ownership rights over private workout data that remains on your device or in your personal cloud account.

However, when you use features that share, publish, transmit, display, export, or make User Content available to others, you grant MatiloLabs LLC a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, display, reproduce, and distribute that User Content solely as needed to operate, provide, maintain, improve, and support those sharing or publishing features.

You represent and warrant that:

• you own your User Content or have permission to use and share it;
• your User Content does not violate the rights of any person or third party;
• your User Content does not violate privacy, publicity, intellectual property, contract, or confidentiality rights;
• your User Content does not contain unlawful, harmful, abusive, obscene, hateful, threatening, or misleading material; and
• your User Content does not provide unsafe instructions intended to harm another person.

Shared or published User Content may be visible to other users or people you share it with. Do not share anything you want to keep private.

9. Routine, Template, and Workout Result Sharing

4M Lift may allow you to share workout routines, templates, or workout results with other users or outside the app.

You are responsible for anything you share. Shared routines, templates, and workout results are not reviewed for medical, safety, fitness, or professional accuracy unless we expressly say otherwise.

You agree not to share content that:

• infringes copyrights, trademarks, or other intellectual property rights;
• copies another person's routine, template, program, or content without permission;
• impersonates another person, trainer, coach, medical professional, or organization;
• claims to diagnose, treat, cure, or prevent any disease or medical condition;
• encourages unsafe, reckless, extreme, or harmful exercise behavior;
• contains harassment, hate, threats, bullying, sexually explicit content, or unlawful material;
• contains spam, advertising, scams, malware, or deceptive links;
• exposes another person's private information without consent; or
• violates these Terms or applicable law.

We may remove or restrict access to shared content, limit sharing features, or suspend accounts if we believe content violates these Terms, creates risk, infringes rights, or may harm users or 4M Lift.

10. Community and Content Moderation

If 4M Lift offers public sharing, community features, discoverable routine libraries, comments, user profiles, or similar social features, we may provide ways to report content, block users, filter content, or contact us.

You agree to use those features responsibly.

We are not required to monitor all User Content, but we may review, remove, restrict, or disable User Content at our discretion. We may also cooperate with law enforcement, regulators, app stores, or rights holders when legally required or when necessary to protect users, the Service, or MatiloLabs LLC.

11. Intellectual Property

4M Lift, including its software, design, logos, branding, graphics, interface, features, functionality, and original content, is owned by or licensed to MatiloLabs LLC and is protected by copyright, trademark, trade secret, and other laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, access, and use 4M Lift for your personal, non-commercial use.

You may not:

• copy, modify, distribute, sell, lease, sublicense, or exploit 4M Lift;
• reverse engineer, decompile, disassemble, or attempt to derive source code from 4M Lift, except where allowed by law;
• remove copyright, trademark, or proprietary notices;
• use our name, logo, branding, or trademarks without written permission;
• interfere with or disrupt the Service;
• bypass payment, entitlement, access, or technical restrictions;
• use automated tools to scrape, harvest, or extract data from the Service; or
• use 4M Lift to build a competing product or service.

12. Feedback

If you send us suggestions, ideas, bug reports, feature requests, or other feedback, you grant MatiloLabs LLC a perpetual, worldwide, royalty-free, irrevocable license to use, modify, publish, and incorporate that feedback without restriction or compensation to you.

13. Free Features and Gated Features

4M Lift may offer a free version with limited features. Certain features may be available only through a paid subscription, free trial, lifetime purchase, promotional offer, or other purchase.

We may change which features are free or paid in the future. If you have already paid for a subscription period, we will not intentionally remove access to the paid features included in that subscription during the paid period unless required for legal, security, safety, platform, or operational reasons.

14. Subscriptions, Free Trials, and Purchases

4M Lift may offer:

• a free trial;
• monthly subscriptions;
• yearly subscriptions;
• lifetime purchases;
• promotional offers; and
• other in-app purchases.

Prices, trial lengths, renewal terms, included features, and billing periods will be shown at the time of purchase and may vary by country, platform, promotion, or app store.

Unless stated otherwise at checkout, subscriptions automatically renew until canceled. You are responsible for canceling before the renewal date if you do not want to be charged.

Purchases made through the Apple App Store, Google Play, or another app marketplace are billed by that marketplace and are subject to that marketplace's payment terms, refund policies, and subscription management rules.

We may use RevenueCat or another third-party service to manage purchase entitlements, subscription status, trials, renewal status, and related purchase events.

Deleting the app or deleting your 4M Lift account does not automatically cancel an active subscription. You must cancel through the app store, platform, or purchase provider where you purchased the subscription.

15. Lifetime Purchases

A "lifetime" purchase means access to the applicable paid features for the lifetime of the 4M Lift service, not your lifetime, the lifetime of any device, or the lifetime of any app store account.

We intend to operate 4M Lift for the long term, but we do not guarantee that 4M Lift, any feature, or any service will be available forever.

A lifetime purchase is personal to your account, non-transferable, and subject to these Terms.

16. Refunds

Except where required by law or required by the applicable app store or payment provider, purchases are non-refundable.

For purchases made through the Apple App Store, Google Play, or another marketplace, refund requests must be submitted through that marketplace unless we provide another process.

We do not control app store refund decisions.

17. Third-Party Services

4M Lift may depend on or interact with third-party services, including app stores, authentication providers, analytics providers, subscription management providers, cloud storage providers, marketing platforms, device operating systems, and personal cloud services.

These third-party services are not controlled by MatiloLabs LLC. Your use of third-party services may be governed by their own terms, policies, settings, and privacy practices.

We are not responsible for third-party services, including their availability, accuracy, outages, data practices, billing practices, security, syncing, backups, or changes.

18. App Store Terms

If you download 4M Lift from the Apple App Store, Google Play, or another app marketplace, you also agree to comply with that marketplace's terms and usage rules.

If these Terms conflict with the applicable marketplace terms, the marketplace terms may control solely with respect to your relationship with that marketplace, billing through that marketplace, or marketplace-required terms.

Apple, Google, and other marketplaces are not responsible for providing maintenance or support for 4M Lift unless required by their own terms or applicable law.

19. Updates

We may provide updates, patches, bug fixes, improvements, or new versions of 4M Lift.

Depending on your device settings, updates may be downloaded and installed automatically. You agree that we may provide updates and that 4M Lift may not function properly if you do not install available updates.

We may stop supporting older versions of the app.

20. Acceptable Use

You agree not to use 4M Lift to:

• violate any law or regulation;
• infringe the rights of another person or organization;
• upload, share, or transmit unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, hateful, or deceptive content;
• share another person's private information without consent;
• send spam, unauthorized advertising, or scams;
• upload malware, viruses, or harmful code;
• interfere with or disrupt the Service;
• attempt to gain unauthorized access to accounts, systems, devices, or data;
• bypass payment, subscription, trial, entitlement, or feature restrictions;
• scrape, harvest, or collect user data without consent;
• impersonate another person or organization;
• misrepresent your fitness, medical, professional, or coaching credentials;
• use the Service to provide medical diagnosis or treatment; or
• use the Service in a way that creates risk of harm to another person.

21. Copyright and Intellectual Property Complaints

We respect intellectual property rights.

If you believe content available through 4M Lift infringes your copyright, trademark, or other rights, contact us at admin@matilolabs.com with enough information for us to review the issue.

We may remove or restrict content that we believe infringes rights and may terminate accounts of repeat infringers.

22. Account Deletion and Termination

You may stop using 4M Lift at any time. If account deletion is available in the app, you may use that feature to request deletion of your 4M Lift account.

We may suspend, restrict, or terminate your account or access to the Service at any time if we believe you violated these Terms, created risk, caused harm, abused the Service, infringed rights, or violated applicable law.

Upon termination, your right to use account-based features will stop immediately.

Termination may not delete:

• workout data stored locally on your device;
• workout data stored in your personal cloud account;
• device backups;
• data retained by app stores or payment providers;
• purchase records required for accounting, legal, fraud prevention, or compliance purposes;
• analytics or attribution data retained in accordance with our Privacy Policy; or
• shared content already exported, copied, downloaded, or reshared by others.

Canceling or deleting your account does not automatically cancel active subscriptions purchased through an app store or third-party payment provider.

23. Disclaimer of Warranties

4M Lift is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, MatiloLabs LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, and reliability.

We do not warrant that:

• 4M Lift will meet your requirements;
• 4M Lift will be uninterrupted, secure, error-free, or available at all times;
• workout tracking, calculations, summaries, analytics, or results will be accurate;
• defects will be corrected;
• data will never be lost or corrupted;
• any routine, template, workout, or shared content is safe or appropriate for you; or
• the Service will continue to offer any specific feature forever.

24. Limitation of Liability

To the maximum extent permitted by law, MatiloLabs LLC and its owners, members, officers, employees, contractors, service providers, licensors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, personal injury, business interruption, device failure, or other intangible losses arising from or related to your use of 4M Lift.

To the maximum extent permitted by law, our total liability for any claim related to 4M Lift or these Terms will not exceed the greater of:

• the amount you paid to MatiloLabs LLC for 4M Lift during the 12 months before the claim arose; or
• $50.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

25. Assumption of Risk and Release

You voluntarily assume all risks associated with exercise, fitness activity, workout planning, use of shared routines or templates, and use of 4M Lift.

To the maximum extent permitted by law, you release MatiloLabs LLC from claims related to injuries, health issues, damages, or losses arising from your fitness activities, your reliance on the Service, your use of routines or templates, or your sharing of workout content.

26. Indemnification

You agree to defend, indemnify, and hold harmless MatiloLabs LLC and its owners, members, officers, employees, contractors, service providers, licensors, and affiliates from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to:

• your use of 4M Lift;
• your User Content;
• your shared routines, templates, or workout results;
• your violation of these Terms;
• your violation of law;
• your violation of another person's rights; or
• your fitness activities.

27. Changes to the Service

We may modify, suspend, discontinue, or limit all or part of 4M Lift at any time.

We are not liable for changes, suspensions, discontinuation, or loss of access to any feature, except where required by law or expressly stated in these Terms.

28. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will make reasonable efforts to notify you, such as through the app, by email, or by posting updated Terms. The updated Terms will be effective when posted unless a later date is stated.

Your continued use of 4M Lift after updated Terms become effective means you accept the updated Terms. If you do not agree, stop using 4M Lift.

29. Governing Law

These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict of law rules.

You and MatiloLabs LLC agree that any dispute arising from or related to these Terms or 4M Lift will be handled in the state or federal courts located in Missouri, unless applicable law requires another forum.

30. Severability

If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in full force and effect.

31. No Waiver

Our failure to enforce any part of these Terms is not a waiver of our right to enforce that part later.

32. Entire Agreement

These Terms, together with the Privacy Policy and any purchase terms shown at checkout, form the entire agreement between you and MatiloLabs LLC regarding 4M Lift.
